Responsibilities

Private-Sector Responsibilities

  • Finance and build the demonstration project using a fixed price, fixed time design-build contract
  • Take responsibility for, and assume risks associated with the construction, scheduling, budgeting, financing and timely delivery of the project
  • Absorb costs for managing, operating and maintaining the facility including routine, preventative and major repairs and capital improvements during the life of the agreement
  • Share revenues with state (or public) if the facility’s financial performance exceeds expectations
  • Implement congestion toll pricing to ensure free-flow traffic conditions
  • Allow free travel for HOV+3, public transit and emergency vehicles
  • Assume relevant project risks during life of the agreement
  • Return facility in good condition based on standards in effect at the end of agreement
  • Develop a traffic management system
  • Provide incident response services.

State’s Responsibilities

  • Ownership and oversight of facility
  • Approval of toll rates
  • Auditing of operational and financial performance
  • Retain the right to improve adjacent facilities, including I-15 and connecting facilities
  • Obtain environmental approvals and acquire needed right of way
  • Outreach and communication with the government agencies, key stakeholders and relevant third-parties.

  • Remain accessible, transparent and accountable to the community
  • Commission traffic and revenue projection studies
  • Coordinate emergency services.
